Assadi Private Capital works closely with legal professionals across Canada to provide short-term, private mortgage financing for clients whose circumstances require speed, flexibility, or structural tolerance beyond what institutional lenders can provide. We lend directly, using our own capital, and we do so exclusively through regulated professionals. We are not a brokerage, we do not solicit the public, and we do not market to borrowers introduced to us by legal counsel or their advisors.

Our role is narrow but critical. We provide liquidity in situations where legal professionals are managing time-sensitive real estate or estate-related matters, often involving procedural complexity, borrower instability, or structurally imperfect assets. We lend on real property, residential, commercial, or mixed-use, and assess files based on asset value, legal clarity, borrower intent, and exit viability. We do not require institutional credit standards, nor do we impose bank-style documentation burdens. Our decisions are guided by judgment, not policy, and our timeline is measured in days, not weeks.

Lawyers who refer files to us are typically working within legal mandates or fiduciary frameworks. They may be acting for estate executors, beneficiaries, separating spouses, parties to litigation, or business owners navigating contractual disputes or insolvency. Our capital is used to solve for delays, uncertainty, or friction: to bridge a sale, to satisfy an arrears payout, to fund a buyout, or to create negotiating space during litigation. We understand that our role is not simply to lend, but to do so in a manner that respects the legal context in which the transaction sits.

We are comfortable working on files where:

• Clients are administering or inheriting an estate, but need interim liquidity before probate completes

• One party to a separation needs to buy out the other, but financing is required before final division

• A client is purchasing real property under time constraints, with complications such as a holdover tenant, deferred maintenance, or unregistered interests

• A court officer or trustee is charged with liquidating a property, but requires short-term financing to settle priority debts, clear title issues, or fund essential repairs

• A borrower is restructuring post-bankruptcy or under a consumer proposal, and needs real estate-backed capital as part of a broader resolution strategy

• There is litigation pending and a secured loan can unlock negotiation or preserve asset value

In these scenarios, conventional lenders either decline the file or require more time than is legally or commercially available. We are positioned to respond quickly. We typically issue a term sheet within 24 to 48 hours of receiving a file summary and can fund most deals within five to seven business days, subject to standard documentation, title review, and legal coordination.

From a lawyer’s perspective, we are easy to work with. We maintain full respect for solicitor-client privilege and will never contact a client directly unless instructed to do so. We provide written commitments and clear terms. Our legal process accommodates independent legal advice and dual representation where necessary, and we are comfortable working with legal counsel in multiple jurisdictions. We also have experience lending into estates, working with family offices, and coordinating with court-appointed trustees or officers under formal mandates.

We are particularly active in regions where institutional lending is sparse or inconsistent, including Manitoba, Alberta, Atlantic Canada, and select secondary markets in Ontario and Saskatchewan. We lend on properties under $100,000, vacant or rural parcels, and urban assets with atypical conditions. We are not deterred by cosmetic issues, fire damage, or unorthodox property history, provided the legal title is clean and the market value supports our position.

We do not compete with lawyers for client relationships. Our business is lending, not retention, upselling, or advisory. Once the transaction is complete, our involvement ceases unless re-engaged by the referring professional. We recognize that legal practitioners operate within a trust-based ecosystem, and we aim to reinforce, not disrupt, that trust.
